Agreement to Terms

By accessing and using Ray Transcribes ("the Service"), operated by Ray Fernando LLC, a California limited liability company, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Ray Transcribes provides automated transcription services for audio and video files. Our service generates text captions and transcriptions using advanced AI technology to help content creators improve searchability and accessibility of their content.

User Accounts and Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use our Service
  • One person or entity may not maintain multiple accounts
  • You are responsible for all activities that occur under your account

Acceptable Use Policy

You agree not to use the Service to:

  • Upload content that violates any laws or regulations
  • Process copyrighted material without proper authorization
  • Upload content containing hate speech, harassment, or discriminatory language
  • Attempt to reverse engineer, hack, or compromise our systems
  • Use the Service for any illegal or unauthorized purpose
  • Share your account credentials with others
  • Upload malware, viruses, or other harmful code

Content and Intellectual Property

Your Content

  • You retain ownership of all content you upload to our Service
  • You grant us a limited license to process your content for transcription purposes
  • You represent that you have the right to upload and process the content
  • We do not claim ownership of your original content or generated transcriptions

Our Service

  • The Ray Transcribes platform, technology, and branding are our intellectual property
  • You may not copy, modify, or distribute our proprietary technology
  • Generated transcriptions are provided for your use and benefit

Subscription and Payment Terms

Pricing and Billing

  • Subscription fees are billed monthly or annually as selected
  • All fees are in USD and exclude applicable taxes
  • Prices may change with 30 days advance notice
  • Payment is processed through secure third-party payment processors

Usage Limits

  • Each plan includes specific monthly transcription minutes
  • Unused minutes do not roll over to the next billing period
  • Additional usage may be available for purchase

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of your current billing period
  • No partial refunds for unused portions of billing periods
  • You retain access to the Service until the end of your paid period

Ray-Fund Guarantee (Refund Policy)

  • Starter Plan: 30-day money-back guarantee
  • Creator + Beta Plan: 60-day money-back guarantee
  • Refunds are available if you are not satisfied with transcription quality and speed
  • Contact us at contact@raytranscribes.com to request a refund
  • Refunds are processed within 5-10 business days
  • Abuse of the refund policy may result in account termination

Service Availability and Performance

  • We aim for high service availability but cannot guarantee 100% uptime
  • Transcription accuracy depends on audio quality and content complexity
  • Processing times are estimates and may vary based on system load
  • We reserve the right to implement fair usage policies
  • Maintenance windows may temporarily affect service availability

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

  • We use industry-standard security measures to protect your data
  • You can request immediate deletion of your data at any time

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAY TRANSCRIBES SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from transcription inaccuracies or errors
  • Service interruptions or technical difficulties
  • Third-party actions or content

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding transcription accuracy or completeness

Indemnification

You agree to indemnify and hold harmless Ray Transcribes from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

Termination

  • We may terminate or suspend your account for violations of these Terms
  • You may terminate your account at any time
  • Upon termination, your right to use the Service ceases immediately
  • We will delete your data according to our data retention policies
  • Provisions that should survive termination will remain in effect

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Service will be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration will take place in California, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or service notifications. Continued use of the Service after changes constitutes acceptance of the new Terms.
